RV Park Rental Agreement
BAR Ranches LLP, hereinafter "BAR RV" does hereby rent to the undersigned, hereinafter "Renter'', the space designated as ("Site") for the placement of a Recreational Vehicle ("RV"), subject the terms and conditions as hereinafter stated:
1. The term of this agreement shall be from period when occupancy begins, for the sum of $500, payable as follows: monthly, weekly or discussed with BAR RV owners. The renter agrees to pay on or before the first of each month and agrees to pay a service charge of 1.5% per month (18% annual percentage rate) that remains outstanding on the 5th of each month. BAR RV shall, at its sole option, extend credit for payments due under this contract and for purchases from BAR RV facilities only to a Renter who has registered a valid Visa, MasterCard, Discover or American Express credit card with property manager.(Note: All credit cards charged will have a 3.25% rate fee associated with each transaction.) By registering a credit card at the Office, the Renter consents to the placement on that credit card of any charges made on Renter's account, any payments due under this contract and any other debt of Renter owing to BAR RV. A deposit of half of the first months rent is required prior to occupancy.
2. The parties hereby acknowledge and agree that the R.V. Rental Site provided herein is for the sole use of a Recreational Vehicle site rental. Please register your vehicles license tag numbers at the front desk upon arrival. Unauthorized vehicles will be towed at the owner’s expense.
3. Renter shall maintain the Site and the RV thereon in a clean and uncluttered condition. The RV occupying the Space shall be kept in a neat, clean and repaired condition at all times.
4. It is mutually agreed that BAR RV shall not be liable for the safe keeping or condition of the RV, or any equipment appurtenant thereto, and the R.V. Owner must carry his or her own insurance thereon. BAR RV shall not be liable for any damage or loss to or of the RV, equipment or any property whatsoever, from any cause whatsoever, or for injury to the Owner(s), guest(s) or invitee(s) or any other persons. The R.V. Owner/Renter, his or her heirs or assigns, hereby agree to indemnify and hold harmless BAR RV from any and all claims, liability or damages for property or personal injury, loss of life to themselves, family, employees, invitees, guests, agents, or any other persons whatsoever, or property damage or property loss howsoever caused.
5. The R.V. Site Renter shall abide by all Rules and Regulations of BAR RV (Exhibit A). BAR RV reserves the right to amend the Rules and Regulations from time to time, which Renter shall abide by.
6. In the event of a breach of this Agreement, or a violation of any of the Rules and Regulations of BAR RV, including, but not limited to, the specific Rules and Regulations governing the Campground, BAR RV may terminate this Agreement in person, or upon written notice to the Site Renter at the address stated below, and Site Renter shall promptly pay all sums due BAR RV and remove the RV from the premises. A failure to remove the RV from the premises promptly of the written notice of termination of this Agreement, shall constitute an abandonment of the RV. BAR RV shall then have a lien against the RV for any sums owing BAR RV, and may sell or otherwise dispose of the property.
7. Site Renter hereby grants BAR RV a security interest in and BAR RV shall have a lien against the described RV, including but not limited to the appurtenances and contents, to secure all amounts owed to BAR RV under this Agreement, any and all other sums owed by Renter to BAR RV, including, without limitation, for unpaid sums due for use of BAR RVs' facilities, purchase of goods, electrical or other services, or for damage caused or contributed to by the described RV by Renter, his guests or invitees, to any property of the BAR RV Park or any other person. BAR RV may exercise any remedy set forth in this Agreement and as otherwise available under the Uniform Commercial Code or applicable law, including taking possession of the RV and the sale of the RV and its contents, without further notice of Renter.
8. Renter/ R.V. Owner's liability insurance, registration and information required. The Owner shall be required to carry personal injury and property damage liability insurance in an amount sufficient to cover any and all damages caused by the described RV, Renter or Renter's guests or invitees. Renter/Owner shall notify BAR RV of any change in address or phone number.
9. Waiver of any one condition by the Park shall NOT be deemed to be a continuing waiver.
10. All persons causing injury or damage to other persons, property or other R.V.'s or Park Models shall be liable therefore, and violations of BAR RV Park rules, disorder, or indecorous conduct by a Renter or their guests that might injure a person, cause damage to property, or harm the reputation of the property, is cause for immediate removal of the RV in question from the premises. Children and pets must be controlled to insure the peace and privacy of other guests and tenants.
11. Renter shall indemnify and hold harmless BAR RV from all costs, losses, or expenses incurred by BAR RV for any damage caused by Renter or Renter's family members or invitees to the property and facilities.
12. Venue for any legal action shall be in the Fifth Judicial District Court of Eddy County in Carlsbad, New Mexico.
13. In the event of a dispute over the terms of this Agreement, the prevailing party shall be entitled to reimbursement of its costs and expenses, including reasonable attorney's fees, with or without litigation.
14. This Agreement shall be deemed to be the complete agreement between the parties. All prior negotiations shall be merged herein. This Agreement may be amended only by written agreement signed by all parties.

BAR RV Park Property Rules & Regulations
Quiet Time
: is from 10:00 PM to 6:00 AM. Please be considerate of others. No loud music, noises, vehicles, or offensive language is allowed at any time. Fireworks and Firearms are strictly prohibited on property.
Conduct:
Disorderly conduct, drunkenness, illegal drugs, obscene language, obnoxious, disruptive or vulgar behavior will not be tolerated. They will be reason for immediate eviction without refund.
Drugs:
Illegal drugs of any form are prohibited on the property of BAR RV Park. Person(s) caught in violation of this rule are subject to immediate eviction without a refund. Person (s) knowing of any illegal activity are encouraged to notify the management immediately. Any information reported will be strictly confidential.
Trash:
Dumpster located in the park is for personal trash only. All garbage must be bagged & tied, boxes broken down. DO NOT leave trash outside by your RV. Cleanliness of the park is important to us. Sites are to be kept clean and orderly, as determined by management. Washing vehicles in the park is prohibited, however; keeping your RV clean and in good repair is required.
Utilities:
Utilities are included in the monthly rate paid at the beginning of each month. Utilities are shared among all Renters, should excessive use of utilities be observed (i.e. constant running of camper A/C, heater units during hours of inoccupancy, water leaks per Renters hose) notices of excessive use will be given.
Sewer
– Sewer Hook up is available per NMED Rules and Regulations, therefore no chemicals may be used, and RV toilet paper is required.
a positive sewer seal at both ends of sewer hose is required. Renter is responsible for keeping line from hook-up in good and working condition. No RV chemicals are allowed.
Water
– Water hookup is available on site. During winter months, Renter is responsible for keeping water hose from the faucet to RV thawed. BAR RV Park is only responsible for the water line to the faucet.
Electrical
– An 50/30/20-amp receptacle is available at each site. This utility is shared among 10 sites and will be monitored for excessive use. A notice will be given if excessive use occurs and could be subject to penalties included to but not limited to, a utility fee of $300, personal meter and/or limited access to utilities.
Speed Limit
is 5 MPH inside Property.
Children:
We want the children to be safe & have a good time, but always under the watchful eyes of a parent/guardian. Please use good judgement if you decide to leave your children at the park when you are gone. We are not responsible for their safety or welfare. You are liable for their behavior.
Visitors & Guests:
Visitors must be accompanied by a Renter when using any of the property facilities.
R.V. Space Renter Vehicles:
One self-contained RV, no more than 20 years old, per campsite. One camping unit and two vehicles per site. All vehicles must be parked within the boundaries of your R.V. Lot site, or in designated area. Renter is not allowed to sublet his or her RV within the RV Park. If Renter sells or transfers title to the RV, the RV must be removed from the RV Park within 24 hours of the transfer of title, unless the new owner enters into a new Agreement with BAR RV Park and pays the appropriate rental amount. Prospective buyers may apply for entrance into the RV Park prior to purchase to examine an RV that is for sale. Proof of insurance and valid registration is required upon request and must be in Renters name.
Vehicles:
Renters must register all vehicles that will be onsite with property manager upon arrival. Any vehicle on an R.V. or vehicle/trailer not registered WILL BE TOWED or considered trespassing. ATV's, motorcycles, scooters, golf carts, and other motorized conveyances (except those used in handicap assistance) may be ridden to enter and leave the property only, provided the sound level is kept to a minimum. No inoperable or unlicensed vehicles will be allowed to remain in the RV Park. Renters shall not use or allow the use of their respective rental space for performance of major mechanical or long-term repairs. All vehicles require proof of insurance and valid registration upon request.
Parking is not allowed on lawn and recreation areas, in vacant sites, or in the streets except for loading and unloading (15 minutes).
Pets:
Having pets in the RV Park is a privilege. Pet owners must secure a Pet Owner Responsibility Agreement (Below) from the office and abide by all of the rules stated. Guests must immediately pick up all droppings. Barking or any other behavior that disturbs other guests is not allowed and noisy or aggressive pets will not be allowed to stay.
Campfires:
Must be in external portable fire pit and not in ground. Fires cannot be used to burn trash or other waste at site. Ashes must not be disposed of in any RV Park waste receptacle.
Repairs:
Only minor emergency repairs to motor vehicles may be made on lots to enable moving of the vehicles to a proper repair facility.
Liability:
The Facilities of the BAR RV Park are available for the convenience of the renters and their guests. All persons using these facilities do so at their own risk. The management or owners will not be responsible for accidents, injuries or loss of property by fire, theft, wind, floods or any unforeseen act beyond their control. Violation of any law or ordinance of the county or state will not be tolerated.
CLOTHS LINES ARE NOT ALLOWED. ELECTRIC SPACE HEATERS ARE NOT ALLOWED. NO CHEATER BOXES OR PIGTAILS ALLOWED. BAR RV Park is not responsible for any electrical components on RV’s.
WE RESERVE THE RIGHT TO IMMEDIATELY EVICT, WITHOUT REFUND, ANYONE VIOLATING THE PARK PARK RULES, STATE OR FEDERAL LAWS, OR COUNTY REGULATIONS. We at the BAR RV Park want you to have a comfortable, healthy and safe stay at your home away from home.
